Effective date

Acceptance

By creating an account, signing in, or using West Coach Swing in any way, you agree to these terms. If you do not agree, please do not use the service.

The service

West Coach Swing is a subscription-based web app that gives members access to West Coast Swing drill videos and a personal practice tracking system. The service is provided by Evenements de Danse Québec Inc., located at 2182 rue Saint-Germain, Saint-Laurent, QC H4L 3T3, Canada, Montreal, Quebec, Canada.

Account responsibilities

You are responsible for keeping your sign-in email secure. Use one account per person; sharing your account with someone else is not allowed. You must give us accurate information when you sign up, and keep it up to date.

Subscriptions and billing

Subscriptions are billed in one of three currencies, US$17.97 per month or US$177 per year in USD; CA$24.97 per month or CA$247 per year in CAD; €16.97 per month or €169 per year in EUR. Which one applies is determined by where you are when you subscribe, and it is shown to you before you pay. Prices are exclusive of tax: applicable sales taxes (such as GST/QST for customers in Canada) are added on top and shown at checkout. Payments are processed by Stripe. Your subscription renews automatically at the end of each billing period until you cancel it. To cancel, go to your Account page, click "Manage subscription", and select "Cancel subscription" in the Stripe billing portal that opens.

From time to time we run promotions, such as a launch discount for early members. Where a promotion applies it is shown at checkout before you pay, and unless we say otherwise it applies to your first billing period only. After that the standard price above applies.

Free trial

New members start with a 7-day free trial. We ask for a payment method up front, but we do not charge it during the trial.

Unless you cancel before the trial ends, the trial converts automatically into a paid subscription and your payment method is charged the price shown at checkout, plus applicable tax. It then renews automatically each period until you cancel.

We email you a reminder about three days before the trial ends. You can cancel at any point during the trial from your Account page, via “Manage subscription”, and you will not be charged. One free trial per person.

Price changes

We may change subscription prices from time to time. If we do, we will notify you by email at least 30 days before the change takes effect. The new price applies on your next billing date after that notice period. You may cancel your subscription at any time before the new price takes effect, at no penalty, from your Account page, and in that case you will not be charged the new price.

Refunds

We do not issue automatic refunds and we do not pro-rate refunds when you cancel. When you cancel, your access continues until the end of the billing period you have already paid for.

Acceptable use

• Do not download, copy, redistribute, or screen-record the videos.
• Do not reverse-engineer or scrape the app.
• Do not access the service through automated tools, bots, or scripts.
• Once social features are available, treat other members with respect. Harassment, hate speech, and abuse are not tolerated.

Intellectual property

All drill videos, written instructions, branding, and app content are owned by Phil & Flore Berne and are protected by copyright. They are used by Evenements de Danse Québec Inc. under licence to operate the service. Your subscription grants you a personal, non-transferable, non-exclusive licence to stream the content for your own practice. You may not record, reproduce, or share the content publicly.

Health disclaimer

Dance involves physical activity. You assume your own risk when practicing. If you have a medical condition, an injury, or any doubt about whether the drills are appropriate for you, consult a qualified healthcare professional before starting. We are not responsible for injuries or health issues that arise from using the service.

Termination

We may suspend or terminate your account if you violate these terms. You can delete your account at any time from your Account page, under “Delete account”.

Deleting your account cancels any active subscription immediately, with no refund for the period you have already paid for, removes you from our mailing lists, and permanently erases your practice history, streaks, badges and favorites. It cannot be undone. If you run into trouble, email info@westcoachswing.com and we'll handle the deletion for you.

Limitation of liability

The service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or available at all times. To the maximum extent allowed by law, we are not liable for service interruptions, lost data, missed practice streaks, or any indirect, incidental, or consequential damages.

Governing law

These terms are governed by the laws of the Province of Quebec, Canada. Any dispute that cannot be resolved informally will be submitted to the courts of Quebec.

Changes

We may update these terms from time to time. If we make material changes, we'll email you before the changes take effect. Your continued use of the service after the effective date means you accept the new terms.
